These Terms of Service (“Terms”, “Terms of Service”, or “Agreement”) govern your access to and use of www.elifperfumes.com (the “Website”) and your purchase of products from Elif Perfumes.

By accessing the Website, browsing our products, creating an account, placing an order, or otherwise using our services, you agree to be bound by these Terms and the policies referenced in them.

If you do not agree with these Terms, please do not use the Website or place an order.

The Website is operated by Elif Perfumes (“Elif Perfumes”, “we”, “us”, or “our”).

There is no separate Elif Perfumes age restriction for ordinary use of the Website.

5. USING THE WEBSITE

7. GOOGLE AND FACEBOOK SIGN-IN

When you use a third-party sign-in service:

The relevant third party may process your information according to its own terms and privacy policy;
We may receive information made available through the sign-in process;
You remain responsible for maintaining the security of your third-party account.

Elif Perfumes does not receive or store your Google or Facebook password through the ordinary third-party sign-in process.

We make reasonable efforts to display our products and product information accurately.

Product information may include:

Fragrance notes;
Product descriptions;
Product photographs;
Product size;
Packaging information;
Price;
Availability.

Product images are intended to provide a representation of the products.

There may be minor differences between photographs displayed on the Website and the physical product, including differences resulting from:

Display technology;
Manufacturing or packaging variations.

Such differences do not necessarily constitute a product defect.

9. FRAGRANCE INFORMATION

Perfume is inherently subjective.

Fragrance descriptions, fragrance notes, recommendations, and other product information are provided to help customers understand and discover our products.

Individual perception of a fragrance may vary based on factors including:

Personal perception;
Individual fragrance sensitivity.

We do not guarantee that a fragrance will smell identical to how it is perceived by another person or described by another customer.

Statements concerning fragrance characteristics are descriptive and are not guarantees of a particular personal experience.

10. FRAGRANCE FINDER

The Website may provide a fragrance finder or recommendation tool.

Recommendations generated through the fragrance finder are intended to assist customers in discovering products based on the information they provide.

The fragrance finder is not a medical, psychological, scientific, or professional assessment.

Recommendations do not guarantee that a particular product will be preferred by a customer.

11. PRODUCT AVAILABILITY

Products displayed on the Website may be subject to availability.

We may:

Update product availability;
Temporarily remove products;
Discontinue products;
Limit quantities;
Correct product information;
Change product specifications;
Change product packaging.

We do not guarantee that every product displayed on the Website will always be available.

12. PRICES

Where an order cannot reasonably be fulfilled because of an obvious error and payment has already been received, we may cancel the affected order and provide any refund required under applicable law.

Receiving an order confirmation or payment confirmation does not prevent Elif Perfumes from taking appropriate action where an order cannot reasonably be fulfilled, including because of:

Obvious pricing or technical errors;
Suspected fraud;
Incorrect or incomplete information;
Delivery restrictions;
Website or payment-system errors;
Other circumstances affecting fulfillment.

Where an order is cancelled by Elif Perfumes after payment has been received, any refund required under applicable law will be handled through the applicable payment process.

16. PAYMENT

Payments are processed through available payment providers.

Elif Perfumes currently accepts online payment through Razorpay.

Payment methods available at checkout may include methods supported by the payment provider at the relevant time.

Elif Perfumes does not currently offer Cash on Delivery (“COD”).

You authorize the applicable payment provider to process the payment associated with your order.

Payment information may be processed by the relevant payment provider according to its own terms and privacy practices.

17. PAYMENT SECURITY

We take reasonable measures to protect transactions and customer information.

Payment credentials such as full card numbers, CVV information, UPI credentials, and banking credentials are handled by the relevant payment provider and are not intentionally stored by Elif Perfumes.

Customers must not provide sensitive payment credentials to Elif Perfumes through email, WhatsApp, social media, or other customer-support channels.

18. DELIVERY

Orders are delivered through delivery providers, including Delhivery.

Delivery times displayed on the Website or provided during checkout are estimates unless expressly stated otherwise.

Delivery timing may be affected by:

Courier operations;
Weather;
Natural events;
Traffic;
Government restrictions;
Regional restrictions;
Incorrect customer information;
Customer availability;
Other circumstances outside our reasonable control.

We will make reasonable efforts to facilitate delivery but cannot guarantee a specific delivery date unless expressly agreed otherwise.

19. CUSTOMER RESPONSIBILITY FOR DELIVERY INFORMATION

You are responsible for providing an accurate and complete delivery address and contact information.

Please ensure that:

The address is correct;
The phone number is active;
Someone is available to receive the order where required;
You respond to delivery communications.

If an incorrect or incomplete address is provided, delivery may be delayed or unsuccessful.

Where possible, Elif Perfumes will work with the customer and delivery provider to resolve delivery issues.

20. FAILED DELIVERY ATTEMPTS

Delivery issues are generally handled through our delivery partner.

If a customer is unavailable, does not respond to the courier, or does not collect a parcel, the delivery provider may attempt delivery again according to its applicable procedures.

Customers should cooperate with delivery attempts and respond to communications from the delivery provider.

Refusing delivery does not automatically constitute an order cancellation or create a right to a refund.

Any rights that cannot lawfully be excluded remain unaffected.

21. RETURNS, REPLACEMENTS AND REFUNDS

Our Return, Replacement & Refund Policy forms part of these Terms.

By placing an order, you acknowledge that you have reviewed and accepted that policy.

Our standard policy is that Elif Perfumes does not provide general returns, change-of-mind exchanges, or ordinary refunds.

The primary exception is an eligible product that arrives physically damaged and is reported within 24 hours of delivery, subject to the requirements and evidence described in our Return, Replacement & Refund Policy.

For an approved damaged-product claim, the standard remedy is replacement rather than refund, subject to applicable law.

Where mandatory consumer law provides a right or remedy that cannot legally be excluded, that right or remedy will continue to apply.

22. ORDER CANCELLATIONS

Our standard policy does not provide customers with a general order-cancellation option after an order has been placed.

However, nothing in these Terms is intended to exclude a cancellation or other consumer right where applicable law requires such a right to be provided.

If Elif Perfumes cancels an order after payment has been received, any refund legally required will be handled through the applicable payment process.

23. PROMOTIONS AND DISCOUNTS

We may occasionally offer:

Discount codes;
Promotional prices;
Limited-time offers;
Seasonal promotions;
Other promotional campaigns.

Each promotion may have additional terms, including:

Elif Perfumes may use customer-submitted reviews, photographs, videos, testimonials, and other User Content for Website content, social media, marketing, advertising, and promotional purposes, subject to applicable law and any permissions required.

26. MODERATION AND REMOVAL OF USER CONTENT

Elif Perfumes may review, moderate, refuse to publish, edit for formatting, or remove User Content where reasonably necessary.

Where permitted by applicable law, Elif Perfumes' aggregate liability relating to a particular order will not exceed the amount actually paid by you for the product or order giving rise to the claim.

Nothing in these Terms is intended to exclude or restrict liability arising from circumstances where such exclusion or restriction would be unlawful.

39. INDEMNIFICATION

To the maximum extent permitted by applicable law, you agree to be responsible for losses, claims, liabilities, costs, or expenses arising from your:

This clause does not require you to indemnify Elif Perfumes for matters caused by Elif Perfumes' own unlawful conduct or liability that cannot legally be transferred to you.

Return, Replacement & Refund Policy;
Other policies expressly referenced on the Website;

form the agreement governing your use of the Website and purchase of products from Elif Perfumes, subject to applicable law.

If there is a conflict between these Terms and a mandatory legal requirement, the mandatory legal requirement will prevail.

44. ASSIGNMENT

You may not transfer or assign your rights or obligations under these Terms without our prior written consent, except where such restriction is not permitted by applicable law.

Elif Perfumes may transfer or assign its rights or obligations in connection with a business restructuring, sale, merger, acquisition, or other lawful business transaction, subject to applicable law.

Subject to mandatory consumer-protection rights and other applicable law, disputes relating to these Terms or your use of the Website will be subject to the jurisdiction of courts having appropriate jurisdiction in India.

Where appropriate, Elif Perfumes and the customer should first attempt to resolve a dispute informally through customer support before commencing formal proceedings.

Nothing in this clause prevents a consumer from exercising a statutory right to approach a competent consumer forum, commission, court, regulator, or other authority where such right is available under applicable law.

46. CONSUMER RIGHTS

Nothing in these Terms is intended to remove or restrict rights available to consumers under mandatory Indian law.

In particular, these Terms should be read consistently with applicable consumer-protection and e-commerce requirements.

Where applicable law gives you a right or remedy that cannot legally be excluded through a contractual term, that right or remedy remains available.
